《广东省实施《中华人民共和国献血法》办法》经2017年8月25日广东省人民政府第十二届110次常务会议通过,2018年1月24日公布,自2018年3月1日起施行。
Measures of Guangdong Province for Implementing the Law of the People’s Republic of China on Blood Donationis adopted at the 110thExecutive Meeting of the 12thSession of the People’s Government of Guangdong Province on August 25, 2017, promulgatedon January 24, 2018, and shall enter into effectas ofMarch 1, 2018.

第一章总则
Chapter I General Provisions
第一条为了保证医疗临床用血需要和安全,保障献血者和用血者的身体健康,发扬人道主义精神,促进社会主义物质文明和精神文明建设,根据《中华人民共和国献血法》,结合本省实际,制定本办法。
Article 1
These Measures are formulated in accordance with the Law of the People’s Republic of China on Blood Donation, in light of the specific situation of this Province, and for the purposes of ensuring the need and safety of blood for medical and clinical use, safeguarding the physical health of blood donors and blood users, carrying forward the humanitarian spirit and promoting the construction of socialist material and spiritual civilization.
第二条本办法适用于本省行政区域内无偿献血、采血、供血、用血活动。
Article 2
These Measures shall apply to the activities of blood donation, collection, supply and use within the administrative areas of this Province.
第三条本省依法实行无偿献血制度。
Article 3
This Province institutesthe system of non-compensatory blood donation system according to law.
无偿献血的血液必须用于临床,不得买卖。
Non-compensatory donated blood shall only be used for clinical purposes and not for sale.
第四条各级人民政府领导本行政区域内的献血工作,统一规划并负责组织、协调、检查和督促有关部门共同做好献血工作。
Article 4
The people's governments at all levels shall exercise leadership in the work of blood donation within their respective administrative areas, make unified plans and be responsible for organizing, coordinating, inspecting and supervising the efforts of relevant departments to do well of blood donation.
各级人民政府应当明确相应机构,负责献血的日常工作,协调有关部门切实履行政府职责。
The people's governments at all levels shall appointcorrespondinginstitutions to be responsible for the daily work of blood donation, and coordinate the relevant departments to effectively perform government functions.
县级以上人民政府应当加强县镇两级献血站(点)、流动献血车建设配备,方便公民献血。
The people's governments at or above the county level shall strengthen the construction and equipping of blood donation stations (centers) and blood donation vehicles at the county and town levels to facilitate citizens' blood donation.
第五条县级以上人民政府卫生健康主管部门负责本行政区域内献血工作的监督管理。其主要职责包括:
Article 5
The competenthealth departments under the people’s governments at or above the county level shall be responsible for the supervision and administration of blood donation within their respective administrative areas. Themain responsibilities include:
(一)制定无偿献血的年度工作目标;
(1)formulating annual work targets for blood donation;
(二)制定血液采集和供应的调剂方案;
(2)formulating a regulation scheme for blood collection and supply;
(三)负责血站的监督管理工作;
(3)responsible for the supervision and management of blood donation stations;
(四)制定重大灾害事故应急采血、供血预案,负责医疗机构用血和应急采血管理工作;
(4)formulating plans for emergency blood collection and supply in major disaster accidents, and responsible for the management of blood use and emergency blood collection of medical institutions;
(五)负责血液质量的监督管理工作;
(5)responsible for the supervision and management of blood quality; and
(六)法律、法规、规章规定的其他职责。
(6)other duties as stipulated by laws, regulations and rules.
第六条各级相关部门应当按照各自职责,共同做好献血的有关工作。
Article 6
Thecompetentdepartments at all levels shall, in accordance with their respective responsibilities, jointly do well of blood donation.
文化、新闻出版、广播电视等部门应当根据献血工作需要,做好相关宣传工作。
The departments of culture, press, publication, radio and television shall do relevant publicity work according to the needs of blood donation.
财政部门应当落实本地区实行无偿献血制度所需必要的经费。
The financial departments shall put into place the funds necessary for the implementation of thenon-compensatory blood donation system in the regionconcerned.
教育部门应当将献血法律、法规及血液生理知识的宣传纳入高等院校、中小学教育内容,指导各级各类学校开展无偿献血知识教育,动员健康适龄的在校学生参加无偿献血。
The education departments shall incorporate the popularization of laws and regulations on blood donation and blood physiological knowledge into the educational contents of higher learning institutionsand primary and secondary schools, guide schools at all levels to carry out education on non-compensatory blood donation, and mobilize healthy students of the right age to participate in non-compensatory blood donation.
规划部门应当将无偿献血站(点)建设纳入城乡规划,按照方便无偿献血者的原则,在卫生健康主管部门提出献血站(点)设置意见的基础上,综合交通、人流量等因素,规划献血站(点)。
The planning departments shall incorporate the construction of blood donation stations (centers) into urban and rural planning, and make a plan for blood donation stations (centers) after taking into account factors such as traffic and human flow according to the principle of making it convenience for blood donors and on the basis of the suggestions put forward by the competenthealth departments on the establishment of blood donation stations (centers).
公安、城管等部门应当在各自职责范围内,根据卫生健康主管部门的需求确定流动献血车停靠点。
The public security, urban management and other departments shall, within their respective responsibilities, determine the parking areas of blood donation vehicles according to the needs of the competenthealth departments.
新闻媒体应当配合相关部门开展献血的社会公益性宣传。
The news media shall cooperate with relevant departments to carry out public welfare publicity for blood donation.
鼓励各级工会、共青团等组织积极参与、推动献血工作。
Organizations such as trade unions and the Communist Youth Leagues at all levels are encouraged to actively participate in and promote blood donation.
第七条机关、企事业单位、社会团体、居民委员会、村民委员会以及其他组织应当动员和组织本单位或者本居住区内的适龄健康公民参加献血。
Article 7
Organs, enterprises and institutions, social organizations, residents' committees, villagers’ committees and other organizations shall mobilize and organize healthy citizens of the right age in their own units or their own residential areas to participate in blood donation.
第八条各级人民政府应当将本行政区域内的无偿献血工作情况纳入地方人民政府绩效考核和文明城市、社区、单位考评体系。
Article 8
The people's governments at all levels shall incorporate the work of non-compensatory blood donation within their respective administrative areas into the performance appraisal system of local people's governments and the evaluation system of civilized cities, communities and units.
各级人民政府和红十字会对积极参加献血和在献血工作中做出显著成绩的单位和个人,给予表扬和奖励。
The people's governments and Red Cross Societies at all levels shall commend and reward units and individuals who have actively participated in and made remarkable achievements in blood donation.
第二章献血和采供血管理
Chapter II Management of Blood Donation, Collection and Supply
第九条血站是采集、提供临床用血的机构,是不以营利为目的的公益性组织。
Article 9
A Blood donation station, being an institution for collecting and providing blood for clinical use, isa non-profitorganization for public benefit.
第十条血站采血、供血应当严格遵守法律、法规以及国家有关的采血、检验、供血标准及技术操作规程和制度。
Article 10
Blood collection and supply at blood donation stations shall be made in strict compliance with laws and regulations, relevant national standards on blood collection, testing and supply, and technical operating procedures and systems.
第十一条提倡18周岁至55周岁的健康公民自愿献血。既往无献血反应、符合健康检查要求的献血者要求再次献血的,年龄可延长至60周岁。
Article 11
Healthy citizens aged 18 to 55 are encouraged to donate blood voluntarily. Where a blood donor who has no previous blood donationreaction and meets the requirements of health examination requests another blood donation, the age may be extended to 60 years old.
鼓励公务员、医务人员、教师和高等学校在校学生参与无偿献血。
State functionaries, medical staff, teachers and students of institutions of higher learning are encouraged to participate in blood donation.
公民献血应当出具本人有效身份证明。公民献血后,由血站发给国务院卫生健康主管部门制作的无偿献血证。
Citizens who donate blood shall show their valid identification. After a citizen donates blood, the blood donation station shall issuea blood donation certificate prepared by the competent health department planning under the State Council.
第十二条血站和医疗机构应当建立和实施保密制度,对献血者的个人资料、献血信息、血液检测结果以及相应的血液使用信息等进行保密,防止未授权接触和对外泄露。
Article 12
Blood donation stations and medical institutions shall establish and implement a system of confidentiality to keep confidential the personal data, blood donation information, blood test results and corresponding blood use information of blood donors, so as to prevent unauthorized contact and external disclosure.
任何单位和个人不得要求无偿献血者证明其所献血液的安全性。
No unit or individual may require anon-compensatory blood donor to prove the safety of his or her donated blood.
第十三条为了保证应急用血,医疗机构可以临时采集血液,具体做法按照国家相关规定执行。
Article 13
In order to ensure emergency blood use, medical institutions may collect blood temporarily, of which the specific practices shall be implemented in accordance with the relevant provisions of the State.
第十四条除依法设立的血站以及医疗单位开展的自体输血采血外,任何单位和个人不得非法从事采血业务。
Article 14
No unit or individual may collect blood illegally except for blood donation stations established according to law and blood collection for auto-transfusion carried out by medical units.
任何单位和个人不得非法组织他人出卖血液。
No unit or individual may illegally organize others to sell blood.
第十五条禁止伪造、变造、买卖、租借无偿献血证。
Article 15
It is prohibited to forge, alter,sell or rent the non-compensatoryblood donation certificate.
第三章用血管理
Chapter III Management of Blood Use
第十六条无偿献血者在本省范围内献血,血液经检验合格的,其本人、配偶和直系亲属享有下列临床用血权利:
Article 16
Where anon-compensatory blood donor donates blood within this Province and his blood passes the test, he and his spouse and immediate family members may enjoy the following rights when using blood for clinical purposes:
(一)无偿献血者献血200毫升及以上的,本人临床用血时免交血液采集、储存、分离、检验等费用;
(1) Where anon-compensatoryblood donor donates blood of 200 ml. or more, he may be exempted from payment of the expenses of blood collection, storage, separation and test when he needs blood for clinical use; and
(二)无偿献血者献血累计600至1000毫升(含1000毫升)的,其配偶和直系亲属临床用血时,合计不超过献血总量2倍范围的,免交前项规定的费用;无偿献血者献血累计超过1000毫升的,其配偶和直系亲属临床用血时,免交前项规定的费用。
(2) Where thecumulativeamount of blood donated by anon-compensatoryblood donor is 600 to 1000 ml. (including 1000 ml.) and his spouse and immediate family members need blood for clinical use, of which the amount of blood needed does not exceed twice ofthe cumulativeamount of blood donated, they may be exempted from payment of the expenses mentioned in the preceding paragraph.
无偿献血者在本省范围内献血,血液经检验不合格的,其本人临床用血时,在不超过献血量3倍范围内免交血液采集、储存、分离、检验等费用。
Wherea non-compensatory blood donor donates blood within this Province and his blood fails to pass the test, he may be exempted from payment of the expenses of blood collection, storage, separation and test when he needs blood for clinical use if it does not exceed three times the cumulativeamount of blood donated.
第十七条临床用血费用纳入基本医疗保险报销范围。
Article 17
The expenses of blood for clinical use shall be included in the coverage of basic medical insurance.
地中海贫血、海洋性贫血、再生障碍性贫血、血友病等长期依赖输血治疗的病种纳入门诊特殊病种范围。
Diseases such as thalassemia, aplastic anemia and hemophilia that rely on long-term transfusion therapy are included in the scope of special outpatient diseases.
本办法第十六条规定免交的费用,由献血所在地人民政府指定的机构或者血站承担,经费在同级财政中列支。具体办法由省卫生健康主管部门会同财政部门另行制定。
The expenses exempted from payment under Article 16 of these Measures shall be borne by the institution or blood donation station designated by the people's government of the place where the blood is donated, and the funds shall be disbursed in the finance at the same level. The specific measures shall be formulated separately by the provincialhealth departmentin conjunction with the financial department.
第十八条医疗机构临床用血应当遵守下列规范:
Article 18
Medical institutions using blood for clinicaluseshall comply with the followingprovisions:
(一)使用依法设立的本行政区域内血站提供的血液。特殊情况下需要在省内调配血液的,由调配双方血站自行协商处理;需要跨省调配血液的,由省卫生健康主管部门组织实施。
(1) Using the blood provided by blood donation stations established according to law within their respective administrative areas. Where blood needs to be dispatched within this Province in special circumstances, it shall be handled by the dispatching and dispatched blood donation stations through consultation; and where blood needs to be dispatched across provinces, it shall be organized and implemented by the provincialhealth department.
(二)储存、运输血液应当符合国家规定的卫生标准和要求。
(2) The storage and transportation of blood shall conform to the sanitary standards and requirements stipulated by the State.
(三)严格执行输血技术规范和制度,科学、合理用血,不得浪费和滥用血液。
(3) Strictly implementing technical norms and systems on blood transfusion, using blood scientifically and reasonably, and no blood shall be wasted or abused.
(四)禁止出售无偿献血血液。
(4) It is prohibited to sell the donated bloodwithout compensation.
(五)按照国家、省、市规定的项目和标准收取用血费用。
(5) Collecting fees for blood use in accordance with the projects and standards prescribed by the State, Province and cites.
(六)在保证急救用血的前提下,优先安排无偿献血者的临床用血。
(6) Under the premise of ensuring blood for first aid, priority shall be given tonon-compensatory blood donors who need blood for clinical use.
第十九条医疗机构应当积极推行节约用血的新型医疗技术,动员符合条件的患者接受自体输血技术,提高输血治疗效果和安全性。
Article 19
Medical institutions shall actively promote new blood-saving medical technologies, mobilize eligible patients to accept autotransfusion technology, and improve the therapeutic effect and safety of blood transfusion.
第四章法律责任
Chapter IV Legal Liabilities
第二十条血站或者医疗机构违反本办法规定,出售无偿献血血液的,由县级以上人民政府卫生健康主管部门予以取缔,没收违法所得,可以并处10万元以下的罚款;构成犯罪的,依法追究刑事责任。
Article 20
Where a blood donation station or medical institution sells donated bloodwithout compensationin violation of the provisions of these Measures, it shall be banned by the competent health department under the people’s government at or above the county level, all illegal income resulting therefrom shall be confiscated, and a fine of up to 100,000 RMB yuan may be concurrently imposed; and where a crime is constituted, criminal liability shall be investigatedintoaccording to law.
第二十一条血站违反本办法第十条规定,未按照有关操作规程和制度采集血液的,由县级以上人民政府卫生健康主管部门责令改正;给献血者健康造成损害的,应当依法赔偿,并对直接负责的主管人员和其他直接责任人员,依法给予处分;构成犯罪的,依法追究刑事责任。
Article 21
Where a blood donation station violates the provisions of Article 10 of these Measures and fails to collect blood in accordance with the relevant operating procedures and systems, it shall be ordered to make corrections by the competent health department under the people’s government at or above the county level; where any damage is caused to the health of blood donors, it shall compensate them according to law, and the persons directly in charge and the other persons directly responsible shall be punished according to law; and where a crime is constituted, criminal liability shall be investigatedinto according to law.
血站违反本办法第十条规定,向医疗机构提供不符合国家规定标准的血液的,由县级以上人民政府卫生健康主管部门责令改正;情节严重,造成经血液途径传播疾病或者有严重传播危险的,限期整顿,对直接负责的主管人员和其他直接责任人员,依法给予处分;构成犯罪的,依法追究刑事责任。
Where a blood donation station violates the provisions of Article 10 of these Measures and provides blood to a medical institution that does not meet the standards prescribed by the State, it shall be ordered to make corrections by the competent health department under the people’s government at or above the county level; where the circumstances are serious enough to cause diseases transmitted by blood or serious risks of spreading diseases, it shall be rectified within aspecified time period, and the persons directly in charge and the other persons directly responsible shall be given sanctionsaccording to law; and where a crime is constituted, criminal liability shall be investigated into according to law.
第二十二条违反本办法第十四条规定,非法从事采血业务或者非法组织他人出卖血液的,由县级以上人民政府卫生健康主管部门予以取缔,没收违法所得,可以并处10万元以下的罚款;构成犯罪的,依法追究刑事责任。
Article 22
Anyone who illegally engages in blood collection business or illegally organizes others to sell blood in violation of the provisions of Article 14 of these Measures shall be banned by the competent health department under the people’s government at or above the county level, all illegalgainsshall be confiscated, and a fine of up to 100,000 RMB yuan may be imposed; and where a crime is constituted, criminal liability shall be investigatedintoaccording to law.
第二十三条医疗机构违反本办法第十八条第一项、第二项、第三项、第五项规定之一的,由县级以上人民政府卫生健康主管部门责令改正;给患者健康造成损害的,应当依法赔偿,并对直接负责的主管人员和其他直接负责人员,依法给予处分;构成犯罪的,依法追究刑事责任。
Article 23
Where a medical institution violates any provisions of Paragraphs 1, 2, 3 and 5 of Article 18 of these Measures, it shall be ordered to make corrections by the competent health department under the people’s government at or above the county level; where any damage is caused to the health of patients, it shall compensate them according to law, and the persons directly in charge and the other persons directly responsible shall begiven sanctionsaccording to law; and where a crime is constituted, criminal liability shall be investigated into according to law.
第二十四条行政机关及其工作人员违反本办法规定,不履行法定职责或者玩忽职守、滥用职权、徇私舞弊的,对直接负责的主管人员和其他直接责任人员依法给予处分;构成犯罪的,依法追究刑事责任。
Article 24
Where an administrative organ and its staff violate the provisions of these Measures and fail to perform their statutory duties or neglect their duties, abuse their powers or engage in malpractices for personal gain, the persons directly in charge and the other persons directly responsible shall be punished according to law; and where a crime is constituted, criminal liability shall be investigatedintoaccording to law.
第五章附则
Chapter V Supplementary Provisions
第二十五条本办法所称的血站,是指在本省依法设立的血液中心及其分支机构、中心血站及其分支机构、中心血库。
Article 25The term “blood donation stations” as mentioned in these Measures refer to blood centers and their branches, central blood stations and their branches and central blood departments established in this Province according to law.
第二十六条本办法自2018年3月1日起施行。广东省人民政府1998年9月30日发布的《广东省实施〈中华人民共和国献血法〉办法》(粤府令第45号)同时废止。
Article 26
These Measures shall become effective as of March 1, 2018. The Measures of Guangdong Province for Implementing the Law of the People's Republic of China on Blood Donation promulgated by the People’s Government of Guangdong Province on September 30, 1998 (Decree of the People's Government of Guangdong No.45) shall be repealed simultaneously.
