　　《港澳流动渔民雇用内地渔工管理办法》经2018年11月18日广东省人民政府第十三届29次常务会议通过，2018年12月13日公布，自2019年2月1日起施行。

　　TheseMeasures on Employment of Mainland Fish Workers by Hong Kong and Macao Migrant Fish Harvesters,adopted at the 29thExecutive Meeting of the 13thSession of the People’s Government of Guangdong Province onNovember 18, 2018 and promulgatedon December 13, 2018, shall enter into effect as ofFebruary 1, 2019.

　　港澳流动渔民雇用内地渔工管理办法

　　Measures on the Employment of Mainland Fish Workers byHong Kong and Macao Migrant Fish Harvesters

　　第一条为了促进粤港澳渔业生产的发展，保护渔业资源，确保边海防的安全，维护内地渔工和港澳流动渔民的合法权益，制定本办法。

　　Article 1

　　These Measures are formulated for the purposes of promoting the development of fishery production in Guangdong, Hong Kong and Macao, protecting fishery resources, ensuring the safety of border and coastal defense, and safeguarding the legitimate rights and interests of Mainland Fish Workers and Hong Kong and Macao Migrant Fish Harvesters.

　　第二条本办法适用于港澳流动渔民在广东省行政区域内雇用内地渔工的有关活动。

　　Article 2

　　These Measures shall apply to the activities of Hong Kong and Macao Migrant Fish Harvesters in hiring Mainland fish workers within the administrative area of Guangdong Province.

　　港澳流动渔民是指持有香港特别行政区或者澳门特别行政区户籍，并同时持有广东省渔业船舶户籍的港澳渔民。

　　For the purpose of these Measures,Hong Kong and Macao Migrant Fish Harvestersrefer to Hong Kong and Macao fish harvesters who hold the registered permanent residence in the Hong Kong Special Administrative Region or the Macao Special Administrative Region and hold the registration of fishing vessels in Guangdong Province.

　　第三条有港澳流动渔民入户的市、县、区人民政府应当加强对港澳流动渔民雇用内地渔工工作的领导。

　　Article 3

　　The people's governments at the municipal, county or district levelsthat have made the registration for Hong Kong and Macao Migrant Fish Harvesters shall strengthen their leadership in the employment of Mainland fish workers by Hong Kong and Macao Migrant Fish Harvesters.

　　县级以上港澳流动渔民工作机构负责港澳流动渔民雇用内地渔工的管理工作。

　　Operating organs for Hong Kong and Macao Migrant Fish Harvesters at or above the county level shall be responsible for managing the employment of Mainland fish workers by Hong Kong and Macao Migrant Fish Harvesters.

　　各级公安边防部门负责港澳流动渔民雇用内地渔工的边防治安管理工作。

　　Border-control forces at all levels shall be responsible for the management of border defence and public security related to the employment of Mainland fish workers by Hong Kong and Macao Migrant Fish Harvesters.

　　第四条港澳流动渔民雇用随船出海的内地渔工总人数，不得超过船舶检验核载人数，其中，雇用需要进入香港水域和指定的香港渔市场作业的内地渔工人数，不得超过香港有关部门核定的渔工配额，相关公安边防部门在核定的渔工配额内发放《粤港流动渔船雇用渔工作业证》（以下简称《作业证》）。

　　Article 4

　　The total number of Mainland fish workers employed by Hong Kong and Macao Migrant Fish Harvesters to have fishing trip with the fishing vessels shall not exceed the number of persons approved in the fishing vessel inspection, among which, the number of Mainland fish workers who need to enter Hong Kong waters and designated Hong Kong fishery markets shall not exceed the quota of fish workers approved by the relevant departments of Hong Kong, and the relevant border-control forces shall issue “Guangdong-Hong Kong Work Permit for Fish Worker Employed by Migrant Fishing Vessel” (hereinafter referred to as the “Work Permit”) within the approved quota of fish workers.

　　第五条受雇的内地渔工应当具有内地户籍且年满18周岁。

　　Article 5

　　Mainland fish workers to be employed shall hold the registered permanent residence in the Mainland and shallhave reached the age of 18.

　　第六条港澳流动渔民雇用内地渔工，应当与拟雇用的内地渔工签订雇用合同，并为受雇的内地渔工购买医疗和人身保险。

　　Article 6

　　Hong Kong and Macao Migrant Fish Harvesters who employ Mainland fish workers shall sign employment contracts with the Mainland fish workers to be employed and purchase medical and life insurance for the employed Mainland fish workers.

　　受雇的内地渔工随船出海作业时，应当持有渔业主管部门颁发的渔业船员证书和公安边防部门颁发的《出海船民证》；需要进入香港水域和指定的香港渔市场作业的，还应当持有《作业证》。

　　The employed Mainland fish workers who have fishing trip with the fishing vessels shall hold the fishery seafarer’ passports issued by the competent fishery authorities and the seaman’s certificates issued by the border-control forces; and where they need to enter the Hong Kong waters and the designated Hong Kong fishery markets, they shall also hold the Work Permits.

　　第七条港澳流动渔民应当为需要随船进入香港地区水域和指定的香港渔市场作业的内地渔工办理《作业证》。办理《作业证》手续如下：

　　Article 7

　　Hong Kong and Macao Migrant Fish Harvesters shall obtain Work Permits for Mainland fish workers who need to enter the Hong Kong waters and the designated Hong Kong fishery markets. The procedures for obtaining Work Permits are as follows:

　　（一）港澳流动渔民向入户市、县、区的港澳流动渔民工作机构提交香港有关部门核定的渔工配额证明、内地渔工身份证明；

　　(1) Hong Kong and Macao Migrant Fish Harvesters submit the quota certificates of fish workers issued by the relevant departments of Hong Kong and the identification papers of Mainland fish workers to the operating organs for Hong Kong and Macao Migrant Fish Harvesters at the municipal, county or district levelsthat have made registration for Hong Kong and Macao Migrant Fish Harvesters;

　　（二）港澳流动渔民入户市、县、区的港澳流动渔民工作机构提出意见，送同级公安边防部门；

　　(2) The operating organs for Hong Kong and Macao Migrant Fish Harvesters at the municipal, county or district levelsthat have made registration for Hong Kong and Macao Migrant Fish Harvesters put forward their opinions and submit the same to the border-control forces at the same level; and

　　（三）市、县、区公安边防部门对材料齐全的，发放《作业证》。

　　(3) The border-control forces at the municipal, county or district levelsissue Work Permits if the materials submitted are complete.

　　港澳流动渔民与持有《作业证》的内地渔工解除雇用关系，应当到入户的市、县、区公安边防部门办理注销《作业证》手续，并将相关证件上交。

　　Hong Kong and Macao Migrant Fish Harvesters who terminate the employment relationships with Mainland fish workers that hold the Work Permits shall go through the formalities for cancelling the Work Permits and hand over the relevant permits and documents.

　　第八条港澳流动渔船返回港澳地区前，应当将雇用的内地渔工送到深圳市的蛇口、盐田、南澳，珠海市的香洲、湾仔、担杆、万山、桂山、洪湾，惠州市的澳头、港口，汕尾市的汕尾、马宫，阳江市的闸坡、东平，台山市的沙堤、广海等其中一个渔港上岸，出海作业时再把上岸的内地渔工接回船上。

　　Article 8

　　Before returning to Hong Kong and Macao, Hong Kong and Macao migrant fishing vessels shall send the employed Mainland fish workers to any fishing port of Shekou, Yantian or Nan'ao in Shenzhen City, or Xiangzhou, Wanchai, Dangan, Wanshan, Guishan or Hongwan in Zhuhai City, or Aotou or Gangkou in Huizhou City, or Shanwei or Magong in Shanwei City, Zhapo or Dongping in Yangjiang City, or Shadi or Guanghai in Taishan City, etc., and pick up such Mainland fish workers back to the fishing vessels when another fishing trip begins.

　　前款规定的渔港需要调整的，由港澳流动渔民工作机构提出，经省人民政府同意后，另行公布。

　　Where the fishing ports specified in the preceding paragraph need to be adjusted, it shall be proposed by the operating organs for Hong Kong and Macao Migrant Fish Harvesters, and shall beseparatelyannounced with the consent of the People’s Government of Guangdong Province.

　　第九条各级港澳流动渔民工作机构、公安边防部门应当加强对内地渔工及其雇主的管理和服务。

　　Article 9

　　The operating organs for Hong Kong and Macao Migrant Fish Harvesters and the border-control forces at all levels shall strengthen the management and service for Mainland fish workers and their employers.

　　鼓励各级港澳流动渔民协会为港澳流动渔民雇用内地渔工提供协助和服务。

　　Associations of Hong Kong and Macao Migrant Fish Harvesters at all levels are encouraged to provide assistance and services for the employment of Mainland fish workers by Hong Kong and Macao Migrant Fish Harvesters.

　　第十条受雇的内地渔工不得随船非法进入香港、澳门、台湾或者其他国家或者地区的水域。

　　Article 10

　　The employed Mainland fish workers shall not illegally enter the waters of Hong Kong, Macao, Taiwan or other countries or regions with the fishing vessels.

　　第十一条违反本办法第七条规定，未按照规定办理《作业证》的，由公安边防部门对雇主处500元以下罚款。

　　Article 11

　　In the event of failure to go through the formalities for obtaining any Work Permit in accordance with the provisions of Article 7 of these Measures, a fine of up to 500RMB yuan shall be imposed by the border-control force on the employer concerned.

　　第十二条违反本办法第八条规定，港澳流动渔民将内地渔工送往规定以外的港口的，由公安边防部门对雇主处1000元以下罚款。

　　Article 12

　　Where any Hong Kong and Macao Migrant Fish Harvester send any Mainland fish worker to a port other than those prescribed in Article 8 of these Measures, a fine of up to 1,000RMB yuan shall be imposed by the border-control force on the employer concerned.

　　第十三条违反本办法第十条规定，受雇内地渔工非法进入香港、澳门、台湾或者其他国家或者地区水域的，按照《中华人民共和国治安管理处罚法》的有关规定处罚；涉嫌犯罪的，依法追究刑事责任。

　　Article 13

　　Any employed Mainland fish worker who illegally enters the waters of Hong Kong, Macao, Taiwan or other countries or regions in violation of the provisions of Article 10 of these Measures shall be punished in accordance with the relevant provisions of the Law of the People's Republic of China on Public Security Administration Punishments; and where a crime is involved, criminal liability shall be investigatedintoaccording to law.

　　第十四条本办法自2019年2月1日起施行。广东省人民政府1995年5月22日颁布的《粤港澳流动渔民雇用境内渔工管理办法》（粤府〔1995〕40号）同时废止。

　　Article 14

　　These Measures shall become effective as of February 1, 2019. The Measures on the Employment of Domestic Fish Workers by Guangdong, Hong Kong and Macao Migrant Fish Harvesters promulgated by the People’s Government of Guangdong Province on May 22, 1995 (Decree of the People's Government of Guangdong No.40 [1995]) shall be repealed simultaneously.
